Welcome to WhiteFrame Creative (“WhiteFrame,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website https://whiteframe.agency (the “Website”), and the services offered by WhiteFrame.

“Client” refers to any individual, business, or entity that engages WhiteFrame for services.
“Services” means creative, strategy, branding, UI/UX design, web design and development, consulting, digital products, or any other services provided by WhiteFrame.
“Deliverables” means creative output, designs, files, or other work product provided by WhiteFrame to a Client.
“Content” means any text, image, audiovisual material, UI elements, code, or other material on the Website.
2. Acceptance of Terms
By accessing the Website or using any of our Services, you agree to these Terms in full. These Terms form a binding legal agreement between you and WhiteFrame. If you are entering into these Terms on behalf of an organization, you represent that you have full authority to bind that entity to these Terms.
3. Use of the Website
You may use our Website for lawful purposes only. You agree not to:
Use the Website in a way that violates any applicable law or regulation
Attempt to gain unauthorized access to restricted areas of the Website
Interfere with or disrupt the Website or its infrastructure
Attempt to harvest or scrape data from the Website
Upload any content that is harmful, infringing, defamatory, or unlawful
WhiteFrame reserves the right to restrict or terminate access to anyone who violates these Terms.
4. Services and Engagement
A. Service Descriptions
WhiteFrame may offer a variety of creative services, including but not limited to:
Brand identity and strategy
Website design and development
UI/UX design
Creative consulting
Digital assets and templates
Ongoing support and maintenance (if contracted)
Detailed terms of any specific engagement (scope, timeline, fees) will be outlined in a separate written agreement, proposal, statement of work, or invoice (“Project Agreement”).
B. Client Responsibilities
Clients agree to:
Provide accurate and complete information
Respond timely to requests for feedback or approval
Provide necessary content, assets, and access
Respect project timelines and payment deadlines
Delays caused by incomplete information or lack of response may affect delivery timelines.
5. Order Processing, Fees, and Payments
A. Fees
Fees for services will be set forth in a Project Agreement. All fees are due in accordance with the schedule in the Project Agreement or invoice.
B. Payments
Payments may be facilitated through third-party payment processors (e.g., Stripe, PayPal). By making a payment, you authorize the processor to charge your selected payment method and agree to the processor’s terms.
C. Taxes
Clients are responsible for any taxes, duties, assessments, or other governmental fees related to services purchased.
6. No Refunds / All Sales Final
All payments made to WhiteFrame Creative are final and non-refundable unless otherwise expressly agreed in writing by WhiteFrame. This includes but is not limited to:
Deposits and milestone payments
Full project payments
Payments for digital assets or services
Fees for consulting, strategy, or creative work
Due to the custom nature of creative services and the time and resources required to deliver them, refunds are not provided once work has started or payments have been processed.
If a project is cancelled by the Client after work has commenced, the Client remains responsible for all fees for work completed and time expended up to the cancellation date.
WhiteFrame may, at its sole discretion, consider exceptions for technical errors or duplicate payments.
7. Intellectual Property
A. Ownership of Website Content
All Content on the Website—including designs, text, graphics, UI components, and code—is owned by WhiteFrame or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without written consent.
B. Ownership of Deliverables
Unless otherwise agreed in a Project Agreement:
Clients will own final deliverables only after full payment has been received.
WhiteFrame retains the right to use all work (including project work) for portfolio, marketing, and promotional purposes, excluding confidential or proprietary client materials.
C. Client-Provided Materials
Any materials provided by a Client (e.g., logos, content, trademarks) remain the property of the Client. The Client represents that they have the right to provide such materials.
8. Third-Party Platforms and Tools
The Website and Services may integrate or rely on third-party platforms and tools, including:
Webflow (hosting and form management)
Calendly (scheduling)
Analytics providers (e.g., Google Analytics)
Payment gateways (e.g., Stripe, PayPal)
WhiteFrame is not responsible for third-party service outages, errors, data collection practices, policy changes, pricing changes, or any service interruptions caused by third parties.
9. Disclaimer of Warranties
The Website and all services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. WhiteFrame disclaims all warranties including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement.
WhiteFrame does not warrant that:
the Website will be uninterrupted, secure, or error-free
the Website or services will meet your specific requirements
any results from use of the Website or services will be accurate or reliable
10. Limitation of Liability
To the maximum extent permitted by applicable law, WhiteFrame Creative and its owners, team members, affiliates, agents, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to:
your use or inability to use the Website or services
errors or omissions in the Content
any action taken in reliance on the Website or services
loss of profits, data, or business opportunities
11. Indemnification
You agree to indemnify, defend, and hold harmless WhiteFrame Creative and its team from and against any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from:

12. Confidentiality
Both parties agree to maintain the confidentiality of non-public information shared during the course of a project and not to disclose such information to any third party without prior written consent, except as required by law.
13. Governing Law and Jurisdiction
These Terms and any disputes arising from them are governed by the laws of the United States without regard to conflict of laws principles. You agree that any legal action or proceeding between you and WhiteFrame shall be brought exclusively in the competent courts located within the United States.
14. Changes to These Terms
We may modify or update these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Website or services after changes are posted constitutes acceptance of the updated Terms.
